The High Court overrules the Council of Ministers’ decision on her early retirement

 

Ramallah – On 30 April 2019, the High Court of Justice handed down its decision in a case instituted by the Independent Commission for Human Rights (ICHR) through its Attorney Ahmed Nassrah. The case involved R. D., a female citizen, who had been retired on pension before she attained the officially established retirement age.

The Court decided to reverse the Council of Ministers’ Decision, dated 20 February 2018, according to which R. D. was forced to retire in reference of the Law By Decree No. 17 of 2017. The High Court of Justice’s ruling sets a precedent, from which citizens with similar cases would benefit.

R. D. had been employed as a teacher at the Ministry of Education for 11 years and four months. The ICHR presented its closing arguments on 25 March 2019.
